WORLD TORT LAW SOCIETY (WTLS) SPECIAL CONFERENCE HELD ONLINE

On November 27, 2021, the special conference of World Tort Law Society (WTLS) was held online successfully. The WTLS directors from the European Centre of Tort and Insurance Law, Wake Forest University, University of Bristol, University of New England, Université Paris 2 Panthéon-Assas, Renmin University of China, Sichuan University, Shandong University, University of Macau, Fu Jen Catholic University and specially invited representatives attended the special conference.

With the theme of “Developments of Book of Tort Liability, Civil Code of China”, the conference was divided into four sections: opening ceremony, keynote report, discussion and closing ceremony.

The opening ceremony was delivered by Yang Lixin, president of WTLS, researcher of Research Centre of Civil and Commercial Jurisprudence of Renmin University of China (RCCCJ) and professor of Law School of Renmin University of China. Professor Yang Lixin expressed his respect for every participant who continued being supportive to WTLS. This conference was centered on the developments of Book of Tort Liability, Civil Code of China, which aimed to give the world a legislative overview of tort liability laws in China. Due to the Covid-19 pandemic, for safety control and prevention purposes, this conference was held online. Professor Yang Lixin looked forward to meeting all the participants in person in the coming future!

The keynote report was moderated by Yao Hui, member of WTLS, director of RCCCJ and professor of Law School of Renmin University of China. Wang Zhu, General Secretary of Executive Committee of WTLS and professor of Law School of Sichuan University, delivered a report entitled “Developments of General Rules in Book of Tort Liability, Civil Code of China”; Man Hongjie, professor of Law School of Shandong University, delivered a report entitled “Developments of Special Rules in Book of Tort Liability, Civil Code of China”.

The discussion was moderated by Tang Xiaoqing, member of WTLS and professor of Law School of University of Macau. All participators discussed the highlights and insufficiencies of the Book of Tort Liability, Civil Code of China. The main topics included: (1) the identification of assumption of risk; (2) the understanding of compensation for emotional harm by breach of contract; (3) the scope of application of punitive damages; (4) apportionment of burden of proof in privacy and personal information infringement cases. Professor Yang Lixin answered relevant questions above these topics. Helmut Koziol, honorary president of WTLS and professor of the European Tort Law and Insurance Law Research Center, Mark Lunney, executive member of Executive Committee of WTLS and professor of University of New England, Jean-Sébastien Borghetti, professor of Université Paris 2 Panthéon-Assas, Ken Oliphant, professor of Bristol University, and Michael D. Green, professor of Wake Forest University, discussed and supplemented relevant issues from their respective jurisdictions.

The closing ceremony was moderated by Wang Zhu, General Secretary of Executive Committee of WTLS and Professor of Law School of Sichuan University. Chen Jung Lung, member of Executive Committee of WTLS, Professor of Law School of Fu Jen Catholic University, delivered a closing speech. Professor Chen Jung Lung said that the Book of Tort Liability, Civil Code of China is distinctive, keeping abreast of the times and highly innovative, which will provide a significant reference for the development of world tort laws. Finally, Professor Chen Jung Lung expressed his sincere appreciation to all participators and looked forward to meeting all the participants in person in the coming future.
